1.   Introduction

These Standard Terms and Conditions (“Agreement”) govern the provision of internet services by Africa Mitaa Digital Services, trading as Mitaa (“ISP”), to the customer (“Customer”). By using the ISP’s services, the Customer agrees to abide by and be bound by this Agreement.


2.   Service Description

The “Services Provided” section describes the various internet services offered by Mitaa. These services include:

1)     Wireless Internet Services:

Wireless Internet Services provide internet connectivity without the need for physical wired connections. It utilizes wireless technology, such as Wi-Fi or radio waves, to establish a connection between a user’s device and the internet service provider. This eliminates the constraints of physical cables and offers flexibility and mobility.

a)      Wireless Internet to Community Hotspots:

This service enables wireless internet connectivity in community hotspots like parks, cafes, and public areas. Users can access the internet wirelessly, providing convenient connectivity for their online needs.

i)        Wireless Internet to the Home:

This service offers wireless internet connectivity directly to residential homes, providing high-speed access for activities like streaming, gaming, remote work, and staying connected with family and friends.

ii)      Wireless Internet to Businesses:

This service caters specifically to businesses, delivering wireless internet connectivity tailored to their unique requirements. It ensures reliable internet access for critical operations, including online transactions, cloud services, video conferencing, and seamless communication with clients and customers.

By providing these wireless internet services, we aim to meet the diverse needs of our customers, whether they are individuals in public spaces, families at home, or businesses striving for seamless operations.

b)     Fibre Internet:

Fibre Internet is a high-speed internet service that utilizes fiber-optic technology to deliver fast and reliable internet connectivity. It involves the use of optical fibers, which are thin strands of glass or plastic that transmit data as pulses of light.

i)        Fibre Internet to the Home:

This service delivers high-speed and reliable internet connectivity directly to residential homes through fiber-optic technology. With faster download and upload speeds, low latency, and a stable connection, customers can enjoy seamless streaming, online gaming, video conferencing, and quick file transfers. Mitaa’s Fibre Internet to the Home enhances the digital experience for households, catering to their growing bandwidth needs and providing a superior internet solution.


3.   Service Coverage

Mitaa provides internet services in the following geographic areas:

1)     Tshwane Metro Municipality:

We offer our services within the Tshwane Metro Municipality, ensuring residents and businesses in this area have access to reliable internet connectivity.

2)     Waterberg District Municipality (Limpopo Province):

Our coverage extends to the Waterberg District Municipality in the Limpopo Province, bringing high-speed internet services to the communities in this region.

3)     Sedibeng District Municipality (Free State):

Mitaa also serves the Sedibeng District Municipality in the Free State, connecting residents and businesses in this area to fast and reliable internet access.

Our aim is to provide comprehensive coverage in these geographic areas, ensuring that individuals, communities, and businesses can benefit from our reliable and high-speed internet services.


4.   Pricing Structure

At Mitaa, we offer competitive pricing plans to suit the diverse needs of our customers. Our pricing structure is designed to provide flexibility and affordability, ensuring that everyone can access the internet services they require. Here are the details of our pricing structure:

a)      Hotspots:

i)        Hotspots:

Mitaa Hotspot Internet (HEWA): Stay connected in peri-urban and rural communities at major meeting points like spaza shops, internet cafes, clinics, libraries, and schools with our accessible and convenient hotspot connectivity. Enjoy seamless online experiences wherever you go with HEWA Hotspot Internet by Mitaa. Pricing options include:

(1)   24-hour access:

Get uninterrupted internet access for a full day with roaming capabilities, allowing you to connect to the HEWA brand of products at all available hotspots within the community. Experience reliable connectivity and stay connected for your online needs. Starting price point of R 7.00.

(2)   week access:

Stay connected throughout the week with roaming capabilities, enabling you to access the HEWA brand of products at all available hotspots within the community. Whether it’s browsing, streaming, or staying connected with friends, enjoy seamless internet access. Starting price point of R 35.00.

(3)   month access:

Enjoy long-term connectivity with roaming capabilities, giving you access to the HEWA brand of products at all available hotspots within the community for an entire month. Stay connected for work, entertainment, and communication with family and friends. Starting price point of R 150.00.

Note: The pricing mentioned above provides customers with the freedom to access the HEWA brand of products at various hotspots within the community, ensuring convenient and reliable internet connectivity for their online experiences.

b)     Wireless Internet to the Home:

Experience high-speed and reliable internet connectivity in the comfort of your home with Mitaa’s Wireless Internet service, a part of the HEWA brand of products. Choose from different speed options to suit your needs:

i)        Basic for Home (5Mb/s):

Enjoy a reliable internet connection with download and upload speeds of 5Mb/s. Stay connected for web browsing, email communication, and streaming media. Starting price of R 300.00.

ii)      Family at Home (10Mb/s):

Get faster speeds for smoother online experiences. Stream high-definition videos, participate in video conferences, and download large files with ease. Starting price of R 500.00.

iii)    Fast Home 20Mb/s:

Maximize your internet experience with blazing-fast speeds. Stream 4K videos, engage in online gaming, and connect multiple devices simultaneously. Starting price of R 800.00.

Note: The pricing mentioned above provides customers with the freedom to choose the desired speed and enjoy the benefits of the HEWA brand of products at their homes. Stay connected, productive, and entertained with Mitaa’s Wireless Internet service.

c)      Fibre Internet:

At Mitaa, we offer Fibre Internet services with pricing that is determined by the customer’s location. Our pricing takes into account various factors, including the availability of fiber infrastructure, the distance from the network, and the desired speed of the connection. To provide accurate pricing, we offer customized quotes for Fibre Internet based on these factors.

Our pricing plans are designed to cater to different types of internet services, ensuring affordability across our range of offerings. Whether you’re accessing hotspots, enjoying wireless internet at home, or benefiting from the high-speed capabilities of Fibre Internet, we strive to provide transparent and competitive pricing. Our aim is to ensure that our customers receive value for their investment in reliable and high-quality internet connectivity.


5.   Data Usage

Mitaa has implemented a fair usage policy that applies to all data packages. For uncapped data packages, there is a limit of 500GB per month. Once the data cap is reached, the customer’s internet service will be subject to throttling, which may result in reduced speeds for the remainder of the billing cycle.

The fair usage policy is in place to ensure that all customers have equitable access to network resources and to maintain optimal performance for everyone. It helps prevent excessive data consumption that may negatively impact the network’s overall quality of service.

Mitaa understands that data usage requirements can vary among customers, and we offer a range of data packages to accommodate different needs. We encourage customers to select a package that aligns with their usage patterns to ensure a satisfactory online experience.

6.   Equipment

Mitaa provides the necessary equipment to enable internet connectivity for its customers. Our equipment is designed to meet the requirements of both household and outdoor use. The equipment includes:

  • Wireless radio equipment: This includes antennas and receivers that enable wireless internet connectivity.
  • Modems: Modems are essential devices that connect your computer or router to the internet service provided by Mitaa.
  • Routers: Routers help distribute the internet connection within your home or business, allowing multiple devices to connect simultaneously.

We ensure that the equipment we provide is of high quality and compatible with our network infrastructure. In case of any issues or malfunctions with the equipment, Mitaa’s customer support team is available to assist you. It is important to note that the equipment provided by Mitaa remains the property of Mitaa and is to be used exclusively for the provision of Mitaa’s internet services. The customer is responsible for the proper use, care, and security of the equipment while it is in their possession.

Mitaa will arrange for the collection of the equipment upon termination of services. The customer is responsible for any damage sustained to the equipment during their use and may be charged accordingly.

In the case where the service has completed a two-year cycle, the equipment shall remain the customer’s property.

8.   Legal Compliance

Mitaa is committed to upholding legal compliance and operating within the regulatory framework of the telecommunications industry. We adhere to the following legal requirements:

a)      Licensing:

Mitaa is a licensed Internet Service Provider (ISP) authorized by the Independent Communications Authority of South Africa (ICASA) to manage and deploy internet networks and offer internet services. We hold multiple ECS (Electronic Communications Services) and ECNS (Electronic Communications Network Services) licenses, ensuring that our operations meet the necessary legal standards.

b)     ISPA Compliance:

Mitaa is a proud member of the Internet Service Providers’ Association (ISPA) and complies with the association’s regulations and codes of conduct. By adhering to ISPA requirements, we demonstrate our commitment to ethical business practices, fair competition, and the protection of customer interests.

9.   Prior Disclosure of Terms and Conditions

As an ISPA member, we ensure that all applicable terms and conditions are made available to customers and potential customers prior to the commencement of any service agreement.

Our terms and conditions outline the rights and responsibilities of both Mitaa and the customer, ensuring a clear understanding of the relationship and the services being provided. We aim to promote informed decision-making and empower our customers to make the best choices for their internet needs.

10.               Privacy

As a proud member of the Internet Service Providers Association (ISPA), Mitaa is committed to upholding your constitutional right to personal privacy and privacy of communications.

We only gather or retain customer information as permitted by law, and we never sell or distribute such information to any other party without your written consent, except when required to do so by law.

We understand the importance of safeguarding your personal information and electronic communications. To ensure the highest level of security, we implement robust measures to protect your data from unauthorized access, use, or disclosure. Our security practices follow industry best practices and comply with all relevant data protection laws and regulations.

In the unlikely event of a data breach or unauthorized access to your personal information or electronic communications, we are committed to promptly notifying you. Our notification will include detailed information about the nature of the breach, the potential risks or harms resulting from it, and any steps you can take to mitigate those risks.

At Mitaa, transparency is a priority. We provide clear and easily accessible information about the types of personal information we collect, the purposes for which it is collected, and the methods we use to collect, store, and process it. You have the right to request access to your personal information and to request its correction or deletion, if necessary.



11.               Removal of Illegal Content

Mitaa upholds a strong commitment to promoting a safe and lawful online environment. As an ISPA member, we have the right to remove any content hosted by us that we deem illegal or for which we have received a valid take-down notice. This includes content that violates applicable laws, infringes upon intellectual property rights, contains hate speech, or promotes harmful activities.

Mitaa actively monitors its network for any potential instances of illegal content and takes swift action to address such issues. If you come across any content that you believe violates our acceptable use policy or any applicable laws, please report it to our customer support team. We appreciate your cooperation in helping us maintain a secure and responsible online community.

By removing illegal content, we strive to create a safer and more inclusive online environment for all our users, promoting responsible digital practices and respecting the rights and well-being of others.


12.               Suspension or Termination of Service

Mitaa reserves the right to suspend or terminate the internet service of any customer who fails to comply with the terms and conditions outlined in this agreement, including acceptable use policies and other contractual obligations. Reasons for suspension or termination may include, but are not limited to:

  • Non-payment: Failure to make timely payments for the internet service.
  • Violation of Acceptable Use Policy: Engaging in activities that breach the acceptable use policy, including unauthorized access, transmission of malware, distribution of illegal content, or any other actions that may harm the network or its users.
  • Abuse of Service: Misuse or excessive use of the internet service that impacts the quality and performance of the network or disrupts the experience of other users.
  • Non-compliance: Failure to comply with legal obligations, regulatory requirements, or any other contractual obligations as outlined in this agreement.

Mitaa will provide notice to the customer regarding any suspension or termination of service, except in cases where immediate action is necessary to protect the network or its users. Customers have the right to dispute any suspension or termination by contacting our customer support team within the specified timeframe provided in the notice.

Upon suspension or termination of service, the customer is responsible for returning any provided equipment to Mitaa. In the case where the service has completed a two-year cycle, the equipment shall remain the customer’s property. However, customers will be liable for any damage sustained to the equipment during use.

Mitaa aims to provide a fair and reliable internet service to its customers. By enforcing suspension or termination, when necessary, we maintain the integrity of our network and ensure a positive experience for all users.



13.               Limitation of Liability

Mitaa strives to provide reliable and uninterrupted internet services. However, there may be instances beyond our control that could affect the performance or availability of the service. Therefore, it is important to acknowledge the following limitations of liability:

  • Service Interruptions: While we make every effort to maintain continuous service, Mitaa does not guarantee uninterrupted access to the internet. Service interruptions may occur due to factors such as network outages, equipment failures, maintenance, or circumstances beyond our control.
  • Third-Party Services: Mitaa may offer links or access to third-party websites, applications, or services for your convenience. However, we do not assume any responsibility for the content, security, or reliability of these third-party services. Any interaction or engagement with such services is at your own risk.
  • Data Security: Mitaa employs measures to protect the security of your data and communications. However, we cannot guarantee that unauthorized access, interception, or loss of data will not occur. It is your responsibility to implement appropriate security measures to protect your own devices and data.
  • Indirect Damages: Mitaa shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use our internet services, including but not limited to loss of data, loss of business, or damage to property.
  • Maximum Liability: If Mitaa is found liable for any damages, our maximum liability shall be limited to the amount you have paid for the specific service during the preceding three months.

It is important to review and understand these limitations of liability. By using Mitaa’s internet services, you acknowledge and accept these terms.

14.               Governing Law and Jurisdiction

These Terms and Conditions and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any legal actions or proceedings arising from or related to these Terms and Conditions shall be exclusively submitted to the jurisdiction of the courts of Pretoria, South Africa.



15.               Severability

If any provision of these Terms and Conditions is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms and Conditions, and the remaining provisions shall continue in full force and effect.



16.               Entire Agreement

These Terms and Conditions constitute the entire agreement between Mitaa and the customer regarding the provision of Internet services. They supersede any prior agreements, understandings, or representations, whether written or oral, relating to the subject matter herein.



17.               Amendments

Mitaa reserves the right to modify or amend these Terms and Conditions at any time, with or without notice, to reflect changes in our services, technology, or legal requirements. Any modifications or amendments will be effective immediately upon posting on our website or notifying customers through other appropriate means. It is the customer’s responsibility to regularly review the Terms and Conditions for any updates or changes.

By using Mitaa’s internet services, you acknowledge and agree to abide by these Terms and Conditions, including the governing law and dispute resolution procedures outlined herein.
